The importance of fighting for joint custody

On Behalf of | Dec 5, 2016 | Parenting Plans And Parenting Time

When you tie the knot with that special someone, you expect that you’ll grow old together. This is particularly true if you have children with the person.

Unfortunately, things have a way of changing over the years. In some cases, too many changes lead to divorce.

Divorce is difficult enough when no children are involved. However, if you have at least one child with your former partner, you know that there are many additional details to work out during the divorce process.

Fathers’ rights

As a father going through divorce in the state of Nebraska, you should have two things on your mind.

First off, you need to do what’s in the best interest of your child. Secondly, you should focus on taking steps that put you in a better position as you move forward with your life.

Due to the fact that there is no statute in the state with regard to shared/joint custody, family law judges have quite a bit of discretion when making decisions.

Even though it shouldn’t hold true in today’s modern age, there is still favoritism towards mothers in child custody cases. For this reason, it can be difficult for the father to get a fair shake, thus putting men in a bad spot during an already difficult time.

Since you want to remain a big part of your child’s life, despite the divorce, you need to do whatever it takes to fight for joint custody. This may not be the ideal situation, but if your relationship is ending in divorce it’s the next best thing.

With joint physical and legal custody, you’ll find it easier to remain a strong figure in your child’s life. Consider the following:

  • Joint physical custody means that you have the right for the child to live with you some of the time.
  • Joint legal custody. With this, you have the legal authority, along with your former spouse, to make key decisions regarding your child’s health, education, and other details associated with his or her upbringing.

As a father, you may run into many challenges when it comes time to fight for joint physical and legal custody. Even so, you have legal rights and you need to do whatever it takes to protect them.
