In the midst of the busy holiday season that will end in a couple of weeks, many Omaha, Nebraska dads may be wondering what their rights and responsibilities are.
Loving fathers who want to be involved in their children’s lives will, no matter their background, in all likelihood want to have some special time with their children during these days and, in most cases, the law gives them the right to have parenting time during the holidays, even if that time is otherwise not consistent with their usual visitation or custody schedule.
As this blog has explained on previous occasions, however, Nebraska strongly favors parents agreeing to and submitting detailed parenting plans to the court overseeing their cases.
If the parents cannot agree, then the court may order them to mediation or may come up with a parenting plan itself, but in contrast to some other states, Nebraska does not do standard parenting time orders. Every case is going to be treated differently, as the circumstances of each family that comes before the court are different.
What this means in practice is that a parenting plan needs to address those important holidays or other special events, such as annual family reunion or vacation, that a man would like to be able to share with his children.
Getting these sorts of provisions in a plan may require a little give and take with the children’s mother, but the most essential thing is that they get addressed and addressed clearly so everyone knows what the expectations are.
